Terms of Service

1. Introduction

Welcome to AlcatrazRP ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the AlcatrazRP website, services, and applications (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility

You must be at least 18 years old to use our Services or make purchases. If you are between 13 and 18 years old, you may use our Services only with the consent and supervision of a parent or legal guardian, and such parent or guardian must agree to these Terms on your behalf. By using our Services, you represent and warrant that you meet these age requirements and have the legal capacity to enter into these Terms.

3. Account Registration

3.1 Discord Authentication

Our Services use Discord for authentication. By creating an account, you agree to provide accurate and complete information and to update such information to keep it accurate and current. You must be a member of our Discord server to use certain features.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Digital Products and Virtual Items

Our Services offer digital products including subscriptions, virtual items, and in-game assets ("Digital Products"). These Digital Products have no monetary value outside of our Services and cannot be exchanged for real currency or transferred to other users unless specifically permitted.

5. Payments and Billing

5.1 Payment Processing

All purchases of subscriptions, virtual items, and products (excluding donations) are processed through Tebex Limited, a third-party payment processor. When making such purchases, you agree to Tebex's Terms of Service and Privacy Policy. Tebex is solely responsible for payment processing, billing inquiries, and transaction-related customer support for these purchases.

Server donations are voluntary contributions processed through Stripe and are strictly non-refundable. Donations do not entitle you to any specific benefits or services and are made without expectation of any consideration in return. By making a donation, you acknowledge it is a final, voluntary contribution to support our community.

5.2 Pricing and Currency

All prices are displayed in USD unless otherwise specified. Prices may vary by region and payment method. Additional fees, taxes, or currency conversion charges may apply depending on your location and payment method, as determined by the payment processor.

5.3 Subscription Renewals

Subscriptions automatically renew at the end of each subscription period unless canceled before the renewal date. You can cancel your subscription at any time through Tebex's customer portal or by contacting Tebex directly. Cancellations take effect at the end of your current billing period.

5.4 Failed Payments

If a payment fails or is declined, your access to subscription benefits may be suspended until payment is resolved. We reserve the right to terminate accounts with repeated payment failures.

5.5 Refund Policy

All purchases of Digital Products are final and non-refundable unless otherwise required by applicable law or Tebex's refund policy. Due to the digital nature of our products, refunds are generally not provided once access has been granted. For donation refunds, contact us directly.

5.6 Chargebacks and Disputes

Initiating a chargeback or payment dispute without first contacting us or Tebex may result in immediate account termination and loss of access to all purchased content and services. We reserve the right to pursue collection of any disputed charges.

6. Discord Integration

6.1 Role Assignment

When you purchase a subscription, you will be automatically assigned specific roles in the AlcatrazRP Discord server. These roles provide access to exclusive channels, features, and content. Roles may be removed immediately if your subscription is canceled, expires, or if your account is terminated for violations of these Terms or Discord's Terms of Service.

6.2 Support Tickets

Certain purchases may automatically create support tickets in our Discord server. You agree to use these tickets only for their intended purpose and in accordance with our support guidelines. Misuse of the ticketing system may result in restricted access.

6.3 Discord Server Rules

All users must comply with our Discord server rules in addition to these Terms. Violations may result in removal from the Discord server and loss of access to purchased benefits, without refund.

7. User Conduct and Restrictions

You agree not to:

  • Use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services
  • Use the Services in any way that violates applicable laws or regulations
  • Engage in any fraudulent activity, payment manipulation, or deceptive practices
  • Attempt to circumvent any security, access restrictions, or payment systems
  • Share, sell, or transfer your account credentials or purchased content to any third party
  • Use automated tools, bots, or scripts to interact with our Services
  • Attempt to reverse engineer, modify, or exploit our Services
  • Create multiple accounts to circumvent restrictions or gain unfair advantages

8. Intellectual Property Rights

8.1 Our Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, software, Digital Products, and virtual items, are owned by AlcatrazRP or its licensors and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services and purchased Digital Products for your personal, non-commercial purposes. This license does not grant you any ownership rights and may be terminated at any time.

9. Third-Party Services

Our Services integrate with third-party services including Discord, Tebex, and Stripe. We have no control over and assume no responsibility for the content, privacy policies, security, or practices of these third-party services. Your use of these services is subject to their respective terms and conditions. Any disputes with third-party payment processors must be resolved directly with them.

10. Service Availability and Modifications

We strive to maintain continuous service availability but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice. We may also modify the features, benefits, or pricing of Digital Products, though existing subscriptions will maintain their original terms until renewal.

11. Account Termination and Effects

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including violation of these Terms, fraudulent activity, or chargebacks. Upon termination, you will immediately lose access to all Digital Products, subscription benefits, Discord roles, and account content, without refund or compensation. Termination does not relieve you of any payment obligations incurred prior to termination.

12. Data and Privacy

We collect and process personal information in accordance with our Privacy Policy. By using our Services, you consent to the collection, processing, and storage of your data as described in our Privacy Policy. This includes Discord profile information, purchase history, and usage data necessary to provide our Services.

13. Disclaimer of Warranties

THE SERVICES AND ALL DIGITAL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALCATRAZ RP, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to defend, indemnify, and hold harmless AlcatrazRP, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees and costs, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, your purchase or use of Digital Products, or your violation of any rights of another party.

16. Dispute Resolution

Before initiating any legal proceedings, you agree to first attempt to resolve disputes through direct communication with us. For payment-related disputes involving Tebex transactions, you must first contact Tebex customer support. Any legal disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except where prohibited by law.

17. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the changes on our website or Discord server. What constitutes a material change will be determined at our sole discretion. Your continued use of the Services after changes become effective constitutes acceptance of the new Terms.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the state where AlcatrazRP is incorporated, without regard to conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in such jurisdiction.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
